Definitions#

Customer: Any professional or capable natural person within the meaning of Articles 1123 et seq. of the Civil Code, or legal entity, who visits the Site that is the subject of these general conditions.
Services: xsec.fr provides Customers with:

Content: All elements constituting the information present on the Site, particularly texts – images – videos.

Customer Information: Hereinafter referred to as “Information(s)” which corresponds to all personal data that may be held by xsec.fr for account management, customer relationship management, and for analysis and statistics purposes.

User: Internet user connecting to, using the aforementioned site.

Personal Information: “Information which allows, in any form whatsoever, directly or indirectly, the identification of the natural persons to whom it applies” (article 4 of law n° 78-17 of January 6, 1978).

The terms “personal data”, “data subject”, “processor” and “sensitive data” have the meaning defined by the General Data Protection Regulation (GDPR: n° 2016-679)

2. General Terms of Use of the Site and Services Offered#

The Site constitutes an intellectual work protected by the provisions of the Intellectual Property Code and applicable International Regulations. The Customer may not in any way reuse, transfer, or exploit for their own account all or part of the elements or works of the Site.

The use of the website xsec.fr implies full and complete acceptance of the general terms of use described below. These terms of use may be modified or supplemented at any time; users of xsec.fr are therefore invited to consult them regularly.

This website is normally accessible to users at all times. However, xsec.fr may decide to interrupt access for technical maintenance purposes, and will endeavor to communicate to users beforehand the dates and times of the intervention. The website xsec.fr is regularly updated by myself. Similarly, the legal notices may be modified at any time: they nevertheless bind the user, who is invited to refer to them as often as possible in order to review them.

The purpose of the website xsec.fr is to provide information concerning all of its activities. xsec.fr strives to provide information that is as accurate as possible on the website. However, it cannot be held responsible for omissions, inaccuracies, and deficiencies in updating, whether by its own doing or due to third-party partners who provide this information.

All information indicated on the website xsec.fr is given for informational purposes only and is subject to change. Furthermore, the information on the website xsec.fr is not exhaustive. It is provided subject to modifications having been made since it was put online.

4. Technical Data Limitations#

The site uses JavaScript technology. The website cannot be held liable for material damage related to the use of the site. Furthermore, the site user agrees to access the site using recent equipment, containing no viruses, and with a latest-generation updated browser. The xsec.fr website is hosted by a provider within the European Union in accordance with the provisions of the General Data Protection Regulation (GDPR: n° 2016-679)

The objective is to provide a service that ensures the best accessibility rate. The host ensures service continuity 24 hours a day, every day of the year. However, it reserves the right to interrupt the hosting service for the shortest possible periods, particularly for maintenance purposes, infrastructure improvements, infrastructure failures, or if the Services generate traffic deemed abnormal.

xsec.fr and the host cannot be held responsible in case of malfunction of the Internet network, telephone lines, or computer and telephone equipment related particularly to network congestion preventing access to the server.

5. Intellectual Property and Counterfeiting#

xsec.fr owns the intellectual property rights and holds usage rights for all elements accessible on the website, particularly texts, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the site’s elements, regardless of the means or process used, is prohibited without prior written authorization from: xsec.fr.

Any unauthorized exploitation of the site or any of its elements will be considered as constituting an infringement and prosecuted in accordance with the provisions of articles L.335-2 and following of the Intellectual Property Code.

6. Limitations of Liability#

xsec.fr acts as the website publisher. xsec.fr is responsible for the quality and truthfulness of the Content it publishes.

xsec.fr cannot be held liable for direct and indirect damage caused to the user’s equipment when accessing the website xsec.fr, resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or incompatibility.

xsec.fr cannot also be held liable for indirect damages (such as loss of market or loss of opportunity) resulting from the use of the xsec.fr website. Interactive spaces (ability to ask questions in the contact space) are available to users. xsec.fr reserves the right to remove, without prior notice, any content posted in this space that would violate applicable law in France, particularly provisions relating to data protection. If necessary, xsec.fr also reserves the right to question the civil and/or criminal liability of the user, especially in case of racist, offensive, defamatory, or pornographic message, regardless of the medium used (text, photograph…).

7. Personal Data Management#

The Client is informed of regulations concerning marketing communication, the law of June 21, 2014, for confidence in the Digital Economy, the Data Protection Act of August 06, 2004, and the General Data Protection Regulation (GDPR: n° 2016-679).

7.1 Personal Data Collection Managers#

7.2 Purpose of Collected Data#

xsec.fr may process all or part of the data:

to enable navigation on the Site and the management and traceability of services ordered by the user: connection data and Site usage, billing, order history, etc.
to prevent and fight against computer fraud (spamming, hacking...): computer hardware used for browsing, IP address, password (hashed)
to improve navigation on the Site: connection and usage data
to conduct optional satisfaction surveys on xsec.fr: email address
to conduct communication campaigns (SMS, email): phone number, email address

xsec.fr does not sell your personal data, which is therefore only used out of necessity or for statistical and analysis purposes.

7.3 Right of Access, Rectification, and Opposition#

In accordance with current European regulations, Users of xsec.fr have the following rights:

right of access (Article 15 GDPR) and rectification (Article 16 GDPR), updating, completeness of user data
right to lock or erase personal user data (Article 17 GDPR), when it is inaccurate, incomplete, equivocal, outdated, or whose collection, use, communication or storage is prohibited
right to withdraw consent at any time (Article 13-2c GDPR)

As soon as xsec.fr becomes aware of the death of a User and in the absence of instructions from them, xsec.fr commits to destroying their data, unless its retention is necessary for evidential purposes or to meet a legal obligation.

If the User wishes to know how xsec.fr uses their Personal Data, ask to rectify it, or oppose its processing, the User can contact xsec.fr in writing at: contactit[.]yarka(at)slmail.me

In this case, the User must indicate which Personal Data they would like xsec.fr to correct, update or delete, by clearly identifying themselves with a copy of an identity document (ID card or passport).

Requests to delete Personal Data will be subject to obligations imposed on xsec.fr by law, particularly regarding the preservation or archiving of documents. Finally, Users of xsec.fr may file a complaint with the supervisory authorities, particularly the CNIL (https://www.cnil.fr/fr/plaintes).

7.4 Non-disclosure of Personal Data#

xsec.fr prohibits itself from processing, hosting, or transferring Information collected on its Clients to a country located outside the European Union or deemed “inadequate” by the European Commission without first informing the client. However, xsec.fr remains free to choose its technical and commercial subcontractors provided they present sufficient guarantees with respect to the requirements of the General Data Protection Regulation (GDPR: n° 2016-679).

8. Incident Notification#

Whatever efforts are made, no method of transmission over the Internet and no method of electronic storage is completely secure. We cannot therefore guarantee absolute security. If we become aware of a security breach, we would inform affected users so that they can take appropriate measures. Our incident notification procedures take into account our legal obligations, whether at the national or European level. We are committed to fully informing our customers of all matters relating to the security of their account and to providing them with all the necessary information to help them meet their own regulatory reporting obligations.

No personal information of the user of the website xsec.fr is published without the user’s knowledge, exchanged, transferred, assigned, or sold on any medium to third parties. Only the hypothesis of the purchase of xsec.fr and its rights would allow the transmission of said information to the prospective buyer who would in turn be bound by the same obligation to store and modify data with respect to the user of the website xsec.fr.

Security

9.1 “COOKIES”#

A “cookie” is a small information file sent to the User’s browser and stored within the User’s terminal (e.g., computer, smartphone), (hereinafter “Cookies”). This file includes information such as the User’s domain name, the User’s Internet Service Provider, the User’s operating system, and the date and time of access. Cookies do not risk damaging the User’s terminal in any way.

xsec.fr may process information about the User’s visit to the Site, such as the pages consulted and searches performed. This information enables xsec.fr to improve the content of the Site and the User’s navigation.

9.2 INTERNET TAGS#

xsec.fr may occasionally employ internet beacons (also known as “tags”, or action tags, single-pixel GIFs, clear GIFs, invisible GIFs, and one-to-one GIFs) and deploy them through a web analytics partner who may be located (and therefore store the corresponding information, including the User’s IP address) in a foreign country.

10. Applicable Law and Jurisdiction#

Any dispute relating to the use of the website xsec.fr is subject to French law. Except in cases where the law does not allow it, exclusive jurisdiction is assigned to the competent courts.
